Partner Terms

By using our Service via the Application (whether now or in the future), you agree to be bound by the Application’s Terms of Use and our Privacy Policy.

Without limiting the terms of our Privacy Policy, we undertake and you agree that:

  1. All data collected through the use of the Application will be collected, stored, managed, updated and disclosed in accordance with our Privacy Policy;
  2. Any data that is collected through your use of the Application, or in respect of end users who nominate you as one of their chosen charities, will not be shared or disclosed to any other charity (or similar organisation) that registers with us.
  3. My Charity Change is authorised to process donations on behalf of your organisation.

If you have elected to register as a Standard Partner, we confirm that no weekly subscription fees will be payable by you.

We warrant and undertake that the fees payable to us are limited to the subscription fees payable to us by you, and we will not withhold or otherwise deduct fees or commissions from the amounts paid by users of the Application that are earmarked for you.

Termination of partnership must be made in writing to admin@mycharitychange.com.au. Termination refers to the removal of charitable organisation from App, website, social media and associated platforms. Upon written confirmation, My Charity Change will have 3 business days to enforce termination. Please note, any outstanding donations will still be processed and donated to the charitable organisation on the Monday following termination notice.

Goodwill

You and we agree with each other to act in good faith at all times in our dealings with each other, and to not knowingly engage in any act or omission which causes damage to the reputation, goodwill or standing of the other. We understand, by extension, we are a representation of your brand and organisation and will always act in a professional and representative manner.

My Charity Change agrees to only publish content, imagery or text that has been authorised in writing by charitable organisation(s). This content is not to be used or distributed to any other third party(s). This content also extends to My Charity Change ambassadors, influencers and staff members.

Payments

Definitions In this agreement

  1. agreement means this Direct Debit Request Service Agreement between us and you.
    b. debit arrangement means the debit arrangements that apply between us and you as set out in this agreement and the direct debit request.
  2. debit day means a day that your account is due to be debited by AUD. Debit payment means a particular debit from your account.
  3. Direct Debit Request means the written, verbal or online request made to us by you to debit funds from your bank account or credit card.

Debit arrangements
  1. By creating a My Charity Change account, you agree to the terms of this agreement and authorise and request us to debit from your account (credit card or bank account) any amount payable to us by you, including any payable.
    b. If the debit day is not a Business Day, we can debit your account on the next Business Day. If you are uncertain about when a debit payment has been or will be processed, you should contact your financial institution.
Disputes
  1. If you believe that we have debited your account incorrectly, contact us using the contact details on the website (www.mycharitychange.com.au or email admin@mycharitychange.com.au) as soon as possible. We can ask you to confirm your query in writing. We will investigate your query and notify you in writing of the action we have taken within 7 days.
  2. If we find that the debit was made incorrectly, we will adjust your account accordingly (including in relation to interest and charges). To the extent permitted by law, we will not be liable for any other losses suffered by you. If we find that the debit was made correctly, we will provide you with reasons and any evidence for this finding.
  3. You can also ask your financial institution to query a debit on your behalf.
Your account
  1. Direct debiting is not available on all accounts and you should check with your financial institution whether direct debiting is available on your account.
    b. It is your responsibility to ensure that the account details provided to us in the direct debit request are correct. You should check those account details against a recent statement from your financial institution.
  2. If you are uncertain about the debit arrangements, you should check with your financial institution before completing the direct debit request.
    d. It is your responsibility to ensure that your account has sufficient clear funds available on a debit day to permit a debit payment to be made in accordance with the direct debit request.
  3. we, us or our means My Charity Change.
Failed payments
  1. If your financial institution does not permit us to process a debit payment on a debit day (whether because there are insufficient clear funds or for any other reason), the following terms apply.
    b. We will notify you in writing and we may charge you reasonable costs incurred by us on your account of there being insufficient funds.
  2. Your financial institution may also require you to pay fees, charges and interest.
  3. Failed payments will be added to the following week(s) donation amount.
Notices

If you are required or wish to give us written notice in relation to the debit arrangements, use the App or email us at admin@mycharitchange.com.au. We will send notices to you by email to the address that you have provided to us. Any notice will be deemed to have been received on the second banking day after sending.

My Charity Change does not incur any payment processing or transaction fees on donations, these are paid exclusively by the user (individual). Processing, administration and transaction fees are as outlined within the My Charity Change Privacy Policy.

Payment from My Charity Change to your organisation will occur on Monday each week to your nominated bank account. My Charity Change does hold any donation funds or store any credit card/banking details.

Security

Your security is our highest priority. My Charity Change works to protect your information, prevent unauthorised account access, and notify you of unusual activity.

My Charity Change Pty Ltd (ABN 58 637 688 898) and My Charity Change and its subsidiaries are regulated and overseen by ASIC.

Your money is insured against fraudulent and criminal activity through Stripe.

User payments are insured against fraudulent and criminal activity through Stripe (https://stripe.com).

Application security and customer peace of mind is our priority. My Charity Change works to protect all customer information, prevent unauthorised account activity and ensure payments are transacted safely.

My Charity Change uses Stripe for payment processing. Stripe has been audited by a PCI-certified auditor and is certified to PCI Service Provider Level 1. This is the most stringent level of certification available in the payments industry.

All card numbers are encrypted at rest with AES-256. Decryption keys are stored on separate machines. Stripe’s infrastructure for storing, decrypting, and transmitting card numbers runs in a separate hosting environment, and doesn’t share any credentials with Stripe’s primary services (API, website, etc.).
